On Friday, Malawi's highest court ruled Madonna can adopt a second child from the African country.
Chief Justice Lovemore Munlo praised Madonna's commitment to helping disadvantaged children and slammed "old laws" that prevented first adoption attempts.
In April, a residency law in Malawi had prevented the divorced 50-year-old from adopting a second child there.
"It's the wee hours of morning in New York, but she is excited at the news," Madonna's lawyer Alan Chinula told the Associated Press. "As her lawyer, I am happy that this has settled this contentious issue."
Preparations are already underway to bring Chifundo "Mercy" James, 3, to America.
The Material Girl adopted David Banda, 3, from Malawi in 2006 and is also mom to Lourdes, 12, and 8-year-old Rocco.
The man believed to be the biological father of Mercy James, the little Malawian girl Madonna is trying to adopt, is speaking out against the pop star's adoption plea.
"I want to take care of her, and I'm capable of taking care of my baby," James Kambewa told "The Early Show," as reported by People magazine. "Mercy, she is a Malawian, so [I] need her to grow as a Malawian...with our culture."
During the interview, Kambewa admitted that he has never met his daughter, and has only seen her "in newspapers and TV, not face to face."
Liz Rosenberg, a rep for the Material Girl, responded saying she doesn't know if James is the girl's father, and that Mercy has been in an orphanage her entire life. Madonna's bid to adopt Mercy began after she met the little girl in 2006.
Kambewa's interview with CBS's "The Early Show" is scheduled to air Monday, the same day the court will hear Madonna's appeal of the rejected adoption
Despite having her bid to adopt a young Malawian girl denied, Madonna has emailed one of the nation's newspapers to explain why she'd still like to care for Mercy, 3.
Madonna, seen yesterday at London's Heathrow Airport with daughter Lourdes, wrote, "I want to provide Mercy with a home, a loving family environment and the best education and healthcare possible." She added, "It's my hope that she, like David, will one day return to Malawi and help the people of their country."
The singer's statement continues, "Though I have been advised that I cannot publicly discuss the pending appeal regarding my desire to adopt Mercy, I do want to say how much I appreciate the level of support that I have received from the people of Malawi and my friends around the world."
After hearing that Madonna's plans to adopt Mercy James, 3, from Malawi didn't work out, Guy Ritchie released a statement expressing his "sadness" over the situation.
"Madonna is a fantastic and loving mother who cares deeply about her own children, and children who may need additional help and support," he said in the statement.
"I fully supported Madonna in her decision to apply for this adoption, and I am saddened that her application has been rejected. She is motivated only by being a caring parent who seeks to share some of the advantages and opportunities that her life has given her," he said of his ex-wife, who has appealed Friday's ruling.
He added, "This time it did not work out, but there will be other opportunities and I wish her well in them. She is a great mum."
Madge and Guy split last year after eight years of marriage. The couple has two children -- Rocco and David. The Material mom also has an older daughter, Lourdes, from her previous relationship with Carlos Leon.
Madonna is in Malawi attempting to adopt 3-year-old Mercy James, but has the Material Mom had her eye on the tot since 2006?
No kidding around, that's the buzz! According to Us Weekly, Madge has wanted the tiny Malawian girl since she was a baby. "About the same time she adopted David, she also wanted to take Mercy," Us Weekly tells "Extra," adding, "but back then, Mercy's family said no."
The "4 Minutes" singer is currently in the African nation addressing the court on the possibility of her adopting Mercy. During her visit, Madonna -- along with kids Lourdes, Rocco and David -- is touring the country. She visited with David's biological father for the first time since the tot moved to London with Madge.
