Halle Berry's ex-boyfriend, Gabriel Aubrey, is being investigated for criminal child endangerment and battery over an incident involving their 3-year-old daughter and their nanny, reports TMZ.

According to the police report, Gabriel allegedly pushed the nanny into a door while she was holding Nahla in her arms.

It all started after the nanny went to pick up Nahla from school, but discovered she was absent. The nanny then went to Aubrey's home, asking why he didn't take the child to school, and that's when Halle's ex allegedly lost his temper, yelling, "You're the f***ing nanny. Who do you think you are? You're nobody. You don't need to f***ing know anything." Gabriel then allegedly pushed the nanny while she was holding Nahla.

The nanny filed a police report, claiming she was injured. The report lists the investigation as a battery, but law enforcement sources tell TMZ they are "definitely investigating child endangerment."

Halle is expected to appear in court on Tuesday.

UPDATE: Sources told TMZ Judge Scott Gordon heard the matter Tuesday morning because the judge who was handling the case is on vacation. After hearing the lawyers arguments, Judge Gordon decided he would not decide, but rather put the matter off until next Monday, when Judge Mark Juhas returns from vacation.
